General terms and conditions

1 Scope

These General Terms and Conditions govern the contractual relationship between Parsenn-Produkte AG (hereinafter: Parsenn-Products) and its Customers. By placing an order, the customer expressly accepts the terms and conditions of Parsenn products as part of the contract.

2 products

The assortment of the ParsennProducts includes drugstore articles of all kinds (except for listed medicines in the speciality lists A to D of the Swiss Agency for Therapeutic Products Swissmedic).

3 Ordering health products
Orders can be placed directly in the online store store.parsenn-produkte.ch or by sending or faxing the order form or by telephone.

4 Delivery

Delivery is made in neutral packaging to any address in Switzerland requested by the customer. Health products are sent by PostPac Priority (A-Post). Delivery is deemed to have taken place upon handover to the post office and the benefit and risk of the products shall pass to the customer.

Retention of title

4.2 Delivery periods and times

Parsenn products delivers the ordered products within 2 - 3 working days after receipt of the order or reorder. In exceptional cases (such as if individual products are not in stock, the manufacturer can not deliver, disruption of traffic, congestion of the Swiss Post or expressly different instructions from the customer), the shipment may be delayed. In such cases, Parsenn products reserves the right to execute an order in partial deliveries. In such cases, delivery or acceptance obligations are suspended to the extent and for the duration of the delay. Any claim for damages on the part of the customer is excluded.

5 Terms of payment

Health Products shall invoice Parsenn Products directly, payable within 30 days. In the event of late payment with respect to previous deliveries, Parsenn Products may refuse orders received without giving reasons. Complaints about goods do not entitle the customer to withhold payment.

6 Retention of title

The products remain the property of Parsenn-Produkte until full payment by the customer. Parsenn-Produkte is entitled to register its retention of title with the competent retention of title register.

7 Conclusion of contract

The presentation of the products in the online store is not a legally binding application, but only represents a non-binding online catalog. If you merely place products in the "shopping cart", this shall not be deemed a binding order. You do not place a binding order for the products in the shopping cart until you click the "Buy Now" button on the order page. The confirmation of receipt of this order is immediately sent by an automated e-mail and does not yet constitute acceptance of the contract. We will then check your order and the availability of the ordered products. We can accept the contract with you either by sending a contract confirmation or by delivering the goods within five days.

8 Return

The customer shall inspect the delivery for any defects immediately upon receipt. The discovery of any defects must be reported to Parsenn-Produkte immediately - if recognizable no later than 8 days after receipt, if not recognizable immediately after discovery - in writing or by telephone. Defective products can be returned in unopened original packaging and in perfect condition after prior contact with Parsenn Products. No defects are minor deviations that are customary in the trade and are based on typical material properties. For hygienic safety reasons, a return of personalized articles, hygiene articles, massage sticks, vaginal balls, etc. is generally excluded in the event of incorrect orders on the part of the customer.

9 Warranties

Parsenn-Products warrants that faultlessly stored products in their original packaging will be delivered. For defective products, Parsenn Products shall deliver a replacement or issue the customer with a corresponding credit note after consultation, unless the customer has not notified the defect in due time in accordance with the above provisions. Any further warranty, in particular for the properties and effects of the products, is excluded to the extent permitted by law. Any repairs of medical devices must be reported to Parsenn products after checking the warranty period. Further product liability and warranty claims are to be directed to the manufacturers of the respective products. For the assertion of any claims, the original invoice must be kept by the customer. After 12 months from delivery of the products, any warranty claims on the part of the customer against Parsenn Products shall expire, even if they have remained undiscovered until then. Parsenn Products shall not be obliged to make a replacement delivery if it proves that it is not responsible for the defect complained of, for example in the case of defective products or services of third parties or in the case of subsequent modification of the products by the customer. Claims for damages due to any errors in the illustrations or in the prices and texts are excluded.

10 Data protection

Parsenn products complies with the Swiss Data Protection Act. It obtains and processes personal data only insofar as this is necessary for business transactions (for example, in dealings with health insurance companies) or on the basis of statutory provisions. In particular, Parsenn-Produkte may disclose data to third parties to the extent necessary to fulfill its legal obligations or if the customer consents to such disclosure. Parsenn Products may also use personal data to maintain its customer relationships, for example in the context of marketing campaigns. It may cooperate with third parties in this regard.

11 Prices

All prices are quoted in Swiss francs (CHF) and include the statutory value added tax as well as any advertised discounts. Prices, colors and products are subject to change without notice and errors excepted.

12 Terms of payment

You have the following options for paying our invoices:
In case of payment on account, the customer undertakes to pay the invoice amount within the period after receipt of the goods. In case of payment by Postfinance or PayPal/Visa, the customer undertakes to pay the purchase price immediately after the conclusion of the contract.

13 Collection

Upon expiry of the payment deadline, the customer is automatically in default, i.e. even without a reminder. If the customer does not meet his debt payment, Parsenn products can claim damages and proceed according to the provisions of the Swiss Code of Obligations (OR). If the debtor has to be reminded due to a delay in payment, he will be charged reminder fees of CHF 10.

14 General

Parsenn-Produkte expressly reserves the right to amend these general terms and conditions at any time. With the use of services of Parsenn-Produkte the present general terms and conditions are considered as accepted without reservation. Deviating conditions of the customer are not binding for Parsenn-Products, subject to express written acceptance. Additional agreements or further commitments of Parsenn-Products require the written form.
